1. Scope
These General Terms and Conditions (Allgemeine Geschäftsbedingungen – AGB; hereinafter “Terms”) apply to all contracts for coaching services and for the purchase of subscriptions, passes and digital and physical products in the online shop between Alexander Schagowsky (hereinafter the “Provider”) and the respective customer (hereinafter the “Customer”).
They also apply to the use of portal functions provided free of charge, in particular the Aspect Carb Lab (see section 2.4). Deviating terms of the Customer will only be recognised if the Provider has expressly agreed to them in writing.
2. Subject matter of the contract and services
2.1 Endurance sports coaching
The Provider offers individual coaching services in the field of endurance sports, including training planning, competition preparation, performance analysis and, on request, nutrition and recovery advice. Support is provided via the athlete portal (app.aspect-sports.com), email and, where applicable, video conferences and telephone.
The Customer undertakes to cooperate actively and to provide all relevant health and performance data required for successful training design.
2.2 Athlete portal
The athlete portal (app.aspect-sports.com) provides registered users with digital tools, training analyses, document management and other functions. Access to the portal and to individual functional areas may be subject to a charge and is activated via subscriptions or one-off purchases (see section 4).
Individual functional areas, in particular the Aspect Carb Lab, are available to registered users free of charge, independently of any paid subscription (see section 2.4).
2.3 Online shop
The online shop (shop.aspect-sports.com) offers digital products (e.g. training plans, e-books, video materials, portal access) as well as physical products. Digital content is protected by copyright and may be used exclusively by the Customer personally. Passing it on, reproducing it or using it commercially is prohibited.
2.4 Aspect Carb Lab
The Aspect Carb Lab is a free-of-charge function of the athlete portal which offers registered users a searchable database of sports nutrition products (including information on carbohydrates, caffeine and certifications) as well as the option of creating a personal product inventory and saving their own ratings and notes on products. Registration in the athlete portal is required; a paid subscription or a coaching contract is not a prerequisite.
2.4.1 Origin and maintenance of the product data
The product information stored in the Aspect Carb Lab is collected automatically from publicly accessible manufacturer websites and is evaluated, structured and continuously updated using AI-assisted methods. Automated retrieval takes place only within the scope of the options granted by the respective manufacturer, in particular in compliance with the robots.txt of the respective manufacturer website; websites whose robots.txt excludes automated access are not read. The information is third-party information (from manufacturers) which is not individually reviewed editorially by the Provider.
2.4.2 Product images
Product photos are displayed in the Aspect Carb Lab only if the Provider holds express written confirmation from the respective manufacturer permitting use of the image. If no such confirmation exists, the product is displayed without an image or with a generic placeholder image.
2.4.3 No substitute for manufacturer information
The information displayed in the Aspect Carb Lab – in particular on nutritional values, caffeine content and certifications (e.g. Kölner Liste, Informed Sport) – is provided for guidance only. It does not replace checking the official product packaging or the information provided by the respective manufacturer.
This applies in particular where the Customer relies on the information to avoid allergies or intolerances or in connection with anti-doping-related decisions (e.g. participation in competitions with doping controls). The Customer is obliged to verify safety-relevant and competition-relevant information independently with the manufacturer.
2.5 Connection to Intervals.icu
The athlete portal offers an optional connection to the training service Intervals.icu of Intervals.icu Ltd (United Kingdom). Use requires the Customer to have their own account with Intervals.icu; this account is governed exclusively by the terms of Intervals.icu. There is no contract between the Provider and Intervals.icu for the benefit of the Customer. The connection is free of charge and is not a prerequisite for using purchased training plans or the coaching.
Via the connection, the Customer can, in each case subject to their own authorisation:
- transfer purchased training plans and the sessions planned in the coaching to their Intervals.icu calendar and have them passed on from there to their devices and platforms,
- synchronise their threshold values (e.g. FTP, lactate threshold heart rate, threshold pace) between the portal and Intervals.icu,
- have completed activities assigned to the training diary of purchased plans, and
- as a coaching athlete, share completed sessions as well as resting heart rate, HRV and Body Battery with the Provider for the coaching (workout and health data).
Section 5 of the privacy policy governs which data are processed in this context. Sharing workout and health data is voluntary and may be revoked at any time. Without such sharing, the Provider bases training management in the coaching on the information provided by the Customer; this does not result in any reduction of the coaching fee.
The Customer is responsible for ensuring that the values stored in Intervals.icu (in particular threshold values and zones) are correct. Values which the Customer confirms in the synchronisation dialogue are overwritten in Intervals.icu or in the portal respectively. The Provider may change, restrict or discontinue the connection, in particular if Intervals.icu changes its interface or terms; sessions already transferred remain unaffected by this, and purchased training plans remain usable in the portal.
3. Conclusion of the contract
3.1 Coaching contract
A coaching contract is concluded by an offer from the Provider and its acceptance by the Customer in writing or digitally.
3.2 Portal subscriptions and one-off purchases
When booking a subscription or one-off purchase in the portal, the Customer submits a binding offer by completing the ordering process (clicking on “Order with obligation to pay” or similar). The contract is concluded upon the confirmation email or the immediate activation of access.
3.3 Online shop
The product presentations in the shop do not constitute a binding offer but an invitation to place an order. The contract is concluded upon completion of the order and the confirmation email.
3.4 Aspect Carb Lab
The usage contract for the free-of-charge Aspect Carb Lab is concluded upon registration in the athlete portal and first use of the function. It is a contract free of charge; the provisions on prices and payment (section 6) and on the right of withdrawal for paid services (sections 7.1 and 7.2) do not apply.
4. Subscriptions and passes
4.1 Subscriptions
Subscriptions grant access to the activated portal functions for the booked term. They are renewed automatically for the agreed period unless they are terminated in due time (see section 5).
Free-of-charge functional areas such as the Aspect Carb Lab are not part of any subscription and are subject to section 2.4 and section 5.4.
4.2 One-off purchase passes
One-off purchases grant access to certain tools or content that is limited in time or by usage. The exact scope and the period of validity are stated in the portal in the respective product description. One-off purchases are non-transferable and expire at the end of the period of validity.
4.3 Right of use
By purchasing a subscription or one-off purchase, the Customer receives a simple (non-exclusive), non-transferable right to use the activated content and functions. Passing on access data or content to third parties is prohibited.
5. Contract term and termination
5.1 Coaching contract
The coaching contract has a minimum term of three months and is thereafter extended for an indefinite period unless it is terminated before the renewal date in text form by email or via the corresponding buttons in the portal.
5.2 Subscriptions
The term and notice period of the respective subscription are stated in the portal in the product description. Termination is possible in text form by email to contact@aspect-sports.com or directly via the buttons provided in the portal. Termination takes effect at the end of the current billing period. Amounts already paid for current periods will not be refunded.
5.3 Extraordinary termination
The right to extraordinary termination for good cause remains unaffected. Good cause on the part of the Provider exists in particular if the Customer is in default of payment despite a reminder or breaches these Terms.
5.4 Aspect Carb Lab
Use of the Aspect Carb Lab is unlimited in time and may be ended by the Customer at any time without notice, in particular by deleting the personal product inventory or the ratings in the portal or by deleting the user account (see sections 7 and 8 of the privacy policy). The Provider reserves the right to discontinue the Aspect Carb Lab or individual functions of it, or to change its content, at any time with reasonable advance notice, provided that this does not cause the Customer any unreasonable disadvantages.
6. Prices and payment terms
6.1 Coaching
The coaching fees are set out in the coaching contract and are payable monthly in advance. In the event of default in payment, the Provider is entitled to suspend the services until payment is received.
6.2 Subscriptions and passes
The prices displayed in the portal at the time of booking apply to subscriptions and passes. Billing takes place in advance via the payment service provider selected in each case.
6.3 Online shop
The prices displayed at the time of the order apply to products in the online shop. Payment is made using the payment methods offered in the shop, currently PayPal, online payment via Stripe (e.g. credit or debit card, Apple Pay, Google Pay, Klarna or SEPA Direct Debit, see section 6.6) and bank transfer. The payment methods available for an order are displayed during the ordering process. Digital content is delivered after receipt of payment or, in the case of payment via Stripe, after confirmation of the payment by Stripe, by providing a download link or direct portal access. Physical products are shipped to the delivery address provided.
6.4 Price information
All prices stated are final prices. As the Provider operates as a small business within the meaning of Section 19 of the German VAT Act (Umsatzsteuergesetz – UStG), no VAT is shown.
6.5 Aspect Carb Lab
Use of the Aspect Carb Lab is currently completely free of charge. There is no entitlement to its remaining free of charge permanently; any future switch to a paid model would be announced to existing customers with reasonable advance notice.
6.6 Payment via Stripe
For online payments in the online shop, the Provider uses the payment service provider Stripe Payments Europe, Limited, One Wilton Park, Wilton Place, Dublin 2, D02 FX04, Ireland (“Stripe”). Various payment methods are available on Stripe's payment page, e.g. credit or debit card, Apple Pay, Google Pay, Klarna or SEPA Direct Debit. Which payment methods are displayed to the Customer depends, among other things, on their country, the currency, the basket and the device used.
- Process: After clicking on “Order with obligation to pay”, the Customer is redirected to Stripe's payment page and completes the payment there. If the payment is declined or the Customer cancels the payment process, no contract is concluded with this payment method; the Customer can place the order again using another payment method offered.
- Failed direct debit: With SEPA Direct Debit, the Customer receives the order confirmation before the payment has been finally confirmed. If the collection fails (e.g. due to insufficient funds or because of an objection), the Provider is entitled to withdraw from the contract; the order is cancelled, digital content is not activated and physical products are not shipped. The Customer is informed of this by email and can order again using another payment method. The Provider may charge the Customer for costs arising from a return debit for which the Customer is responsible.
- Charging: The purchase price is charged immediately upon completion of the order, including for physical products. With SEPA Direct Debit, Stripe collects the amount from the Customer's account; confirmation of the payment may take a few working days. Digital products are activated after Stripe has confirmed the payment.
- Payment with Klarna: If the Customer selects Klarna on the payment page, payment is made via Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden (“Klarna”). Klarna decides in each individual case which Klarna payment methods (e.g. instant payment, invoice or instalments) are offered. Pay by invoice and instalment purchase are only available to consumers aged 18 and over and require a successful identity and credit check by Klarna. Due dates, payment deadlines and any instalment arrangements are governed by Klarna's terms; in this case, payments must be made to Klarna.
- Third-party terms: Payments with Klarna, Apple Pay or Google Pay are additionally subject to the terms of the respective provider, which are displayed to the Customer during the payment process.
- Refunds: The Provider initiates refunds following a withdrawal, a cancellation or a complaint via Stripe. The amount is credited back to the payment method originally used; in the case of payment with Klarna, Klarna credits the amount or adjusts outstanding invoices or instalments.
7. Right of withdrawal
7.1 Coaching contracts and subscriptions
The Customer has the right to withdraw from the contract within 14 days of the conclusion of the contract without giving any reason. The withdrawal must be addressed in text form by email to contact@aspect-sports.com.
If performance begins at the Customer's express request before the withdrawal period expires, the Customer must pay a pro rata amount for the part of the service provided up to the withdrawal (Section 357(8) of the German Civil Code (Bürgerliches Gesetzbuch – BGB)).
7.2 Digital content (shop and passes)
In the case of digital content not supplied on a tangible medium, the right of withdrawal expires pursuant to Section 356(5) BGB as soon as performance of the contract has begun, i.e. upon download or activation of access, provided that the Customer has expressly consented in advance to performance of the contract beginning before the withdrawal period expires and has confirmed their knowledge that the right of withdrawal will thereby expire.
7.3 Physical products
For physical products, there is a 14-day right of withdrawal from receipt of the goods. Returns are at the Customer's expense unless otherwise agreed.
7.4 Model withdrawal form
A model withdrawal form is made available to the Customer as part of the ordering or booking process.
7.5 Aspect Carb Lab
As use of the Aspect Carb Lab is free of charge, there is no right of withdrawal within the meaning of the preceding paragraphs. The Customer may end use at any time in accordance with section 5.4.
8. Exclusion of liability
8.1 General
The Provider is liable without limitation for intent and gross negligence, for damage resulting from injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz) and to the extent of any guarantee assumed. In the case of slight negligence, the Provider is only liable for breach of essential contractual obligations (cardinal obligations), i.e. obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment the Customer may regularly rely; in this case, liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded. The following sections 8.2 to 8.5 apply only within the framework of this section 8.1.
8.2 Health and training
Participation in the training is at the Customer's own risk. The Customer confirms that their state of health allows them to carry out the recommended training content and that they have sought medical advice in case of uncertainty. The Customer shall inform the Provider without undue delay of any injuries, illnesses or complaints that may be relevant to the design of the training. For injuries or damage to health resulting from carrying out recommended training sessions, the Provider is only liable in accordance with section 8.1, and in particular not insofar as they are based on incorrect or omitted information from the Customer.
8.3 Digital products and portal
The Provider is not liable for interruptions of portal access or unavailability of digital products that are due to circumstances beyond its sphere of influence (e.g. server outages at the hosting provider, internet disruptions). No liability is accepted for any incompatibility of digital content with the Customer's software or hardware.
8.4 Product database of the Aspect Carb Lab
The product information provided in the Aspect Carb Lab is collected automatically and with AI assistance from publicly accessible manufacturer sources. The Provider does not warrant the accuracy, completeness or currency of this information, in particular not of the information on nutritional values, caffeine and certifications (including Kölner Liste, Informed Sport). Liability for damage resulting from the use of incorrect, incomplete or outdated product data – including damage to health caused by allergies or intolerances and consequences under sports law in connection with anti-doping regulations – is excluded unless it is based on intent or gross negligence on the part of the Provider. Section 8.1 otherwise remains unaffected.
8.5 Third-party services (Intervals.icu, devices, payment service providers)
The Provider is not responsible for the availability and functionality of third-party services, in particular Intervals.icu, synchronisation to devices and platforms (e.g. Garmin, Wahoo, Zwift) and payment service providers such as PayPal, Stripe and Klarna. This applies in particular to changes to or failures of the interfaces of these services and to deviations in the display of workouts on end devices. The Provider does not warrant the accuracy or completeness of data supplied by Intervals.icu or the Customer's devices (e.g. heart rate, power, HRV). The Provider's liability for its own breaches of duty under section 8.1 remains unaffected.
9. Copyright and rights of use
All training plans, analyses and documents created in the course of the coaching, as well as all digital content provided via the shop or the portal, are protected by copyright. The Customer receives exclusively a simple (non-exclusive), non-transferable right of use for private purposes. Any use beyond this – in particular passing on, publication, reproduction or commercial exploitation – requires the express written consent of the Provider.
9.1 Third-party product data (Aspect Carb Lab)
The product information displayed in the Aspect Carb Lab originates from the respective manufacturers and is connected with their rights. The structured compilation and processing of these data in the database of the Aspect Carb Lab is carried out by the Provider; reproduction, systematic re-use or export of the database or substantial parts of it by the Customer is not permitted.
10. Data protection
Personal data are processed exclusively for the provision of the contractual services and in accordance with the applicable privacy policy at shop.aspect-sports.com/en/legal/privacy. A separate declaration of consent to the processing of special categories of personal data (in particular health and performance data) is obtained in the course of the conclusion of the contract. For workout and health data from Intervals.icu, the Provider obtains consent separately via the “Für dein Coaching” (“For your coaching”) authorisation in the portal (section 2.5). When paying via Stripe, Stripe and, if the Customer chooses Klarna, Klarna process the data required for the payment (section 6.6 and section 3.3 of the privacy policy).
11. Final provisions
11.1 Individual agreements, form and amendments
Agreements made with the Customer in individual cases take precedence over these Terms. Where these Terms require a particular form for declarations, text form is sufficient, e.g. an email to contact@aspect-sports.com or use of the corresponding buttons in the portal.
An existing contract is governed by the Terms in the version agreed when the contract was concluded. If the Provider wishes to amend the Terms for ongoing contracts, it will notify the Customer of the amendments in text form; they will only take effect if the Customer expressly agrees to them. If the Customer does not agree, the contract continues on the previous terms; the right of both parties to terminate in accordance with section 5 remains unaffected.
11.2 Severability clause
Should any provision of these Terms be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that comes closest to the economic purpose of the invalid provision.
11.3 Applicable law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
11.4 Place of jurisdiction
The place of jurisdiction for all disputes arising from and in connection with these Terms is the Provider's place of business, provided that the Customer is a merchant (Kaufmann), a legal entity under public law or a special fund under public law. For consumers, the statutory place of jurisdiction applies.
